TERMS OF AUCTION

Art Gems 2025/Good Shepherd Non-Profit Homes makes no warranties or representation of any kind or nature with respect to any work of art including, but not limited to, any representation or warranty of description, genuineness, attribution, provenance, or physical condition, nor as to the right of reproduction, if any. Bidders and purchasers may not rely upon any statement of Art Gems 2025/Good Shepherd Non-Profit Homes, verbal or otherwise, other than as set forth in these conditions of sale.

 

CONDITIONS OF SALE

The stated value of each lot is the artist’s normal retail pricing for a work of comparable size and medium. This pricing has been provided by the artist or the artist’s representative. No representation or warranty as to the actual resale value of any work being auctioned is hereby made or implied.

 

LIVE AUCTION

Works will be offered in the order in which they appear in this catalogue, unless otherwise announced by the auctioneer. All bidders must be registered to bid and provide a valid credit card. Registered bidders will be given a paddle number. The successful bidder’s paddle number will be acknowledged by the auctioneer to confirm sale of the lot. If your bid is successful, your credit card will be charged unless alternative arrangements have been made prior to the end of the sale. Title to the offered lot will pass to the successful bidder once full payment has been made, at which time the purchaser will assume full risk and responsibility for the lot.

Bids are advanced at the auctioneer’s sole discretion, and a work may be withdrawn from the auction should it not meet a minimum standard based on its value. In the event of any dispute between bidders, missed bids, or in the event of doubt as to the validity of any bid, the auctioneer will have at his discretion the final authority to determine the successful bidder or to re-offer or withdraw the work in dispute.

If any dispute arises after the auction, the Art Gems 2025 record of the auction proceedings shall be conclusive. All monies will be collected by Art Gems/Good Shepherd on behalf of Art Gems 2025.

 

RULES FOR LIVE AUCTION

Successful bidders will be notified within the Live Auction, and the purchase will be charged to their Visa, Mastercard or AMEX as indicated on their completed registration form.

All sales are final. No purchase can be returned, refunded, or exchanged. All property is sold as is, as exhibited. If the final purchase price is equal to or greater than 125% of the published price, the purchaser will be issued a charitable tax receipt for the difference between that value and the selling price. Successful bidders should be prepared to pay for their purchases by Visa, Mastercard, AMEX, or by personal cheque payable to Art Gems/Good Shepherd on the evening of the auction. No PST, HST or auction commission is applicable. The purchaser has the option to provide a replacement cheque of the purchase price within 48 hours of notification. Payments by cheque are payable to Art Gems/Good Shepherd and must be provided within 48 hours of the sale.

Art Gems 2025 reserves the right to withdraw any work of art at any time before the actual sale.

 

PICK-UP

All works must be paid for at the conclusion of the auction evening. Purchasers must pick up works at the conclusion of the auction evening upon proof of payment.

Art Gems 2025/Good Shepherd Non-Profit Homes is not responsible for acts or omissions by carriers or packers of purchased lots, whether or not recommended by it. Neither Art Gems 2025/Good Shepherd Non-Profit Homes, nor its paid agents or volunteers, shall be liable for any loss or damage to the purchased lot, whether caused by negligence or otherwise while that lot is in or under its custody or control.
